1. Acceptance of Terms

By accessing or using Event Selfie Studio ("the Service"), operated at eventselfiestudio.com and its subdomains, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("you", "your") and Event Selfie Studio ("we", "us", "our"). By creating an account, subscribing to a plan, or using any feature of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Event Selfie Studio is a multi-tenant SaaS platform that enables event organisers to collect, moderate, and display guest photos and selfies in real time. The Service includes event creation and management, guest photo upload interfaces, AI-powered and manual content moderation, real-time slideshow display, QR code access for event guests, and administrative tools for managing events and uploads.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

3. Registration and Accounts

To use the Service as an event organiser, you must register for an account by providing a valid email address, business name, and a unique subdomain. You are responsible for:

Providing accurate and complete registration information
Maintaining the security and confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or have been inactive for an extended period.

4. Payment Terms

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected
All payments are processed securely through Stripe. You agree to Stripe's terms of service in addition to these Terms
Prices are quoted in GBP and are exclusive of applicable taxes unless otherwise stated
You authorise us to charge your payment method for recurring subscription fees
Subscription renewals occur automatically unless cancelled before the renewal date
Refunds are handled on a case-by-case basis. We do not offer automatic refunds for unused portions of a billing period

We reserve the right to change our pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing period.

5. Free Trial

We may offer a free trial period for new accounts. During the trial, you will have access to a limited set of features as described on our pricing page. The free trial is subject to the following conditions:

One free trial per individual or organisation
Free trial accounts are limited to 100 selfies per event and a maximum of 3 events
We reserve the right to terminate free trial accounts that are created to circumvent these limitations
At the end of the trial period, you may upgrade to a paid plan to continue using the Service
Data from trial accounts may be deleted if no paid subscription is activated within 30 days of trial expiration

6. User Content

"User Content" refers to any photos, images, text, or other materials uploaded to the Service by you or your event guests. Regarding User Content:

You retain ownership of all User Content you upload to the Service
By uploading content, you grant us a limited, non-exclusive licence to store, process, display, and transmit the content solely for the purpose of providing the Service
You represent and warrant that you have the necessary rights to upload all content and that such content does not infringe on any third party's intellectual property or other rights
As an event organiser, you are responsible for obtaining any necessary permissions or consents from your event guests for the collection and display of their photos
We reserve the right to remove any content that violates these Terms or applicable law

7. Acceptable Use

You agree not to use the Service to:

Upload, display, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
Upload content depicting the exploitation or abuse of minors
Infringe on any intellectual property rights, trade secrets, or privacy rights of others
Impersonate any person or entity, or falsely state or misrepresent your affiliation
Transmit viruses, malware, or other malicious code
Attempt to gain unauthorised access to the Service, other accounts, or connected systems
Use the Service for any purpose that is unlawful or prohibited by these Terms
Scrape, crawl, or use automated means to access the Service without prior written consent
Interfere with or disrupt the Service or servers connected to the Service

Violation of the acceptable use policy may result in immediate account suspension or termination without refund.

8. Data Protection

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. As an event organiser using the Service:

You act as the data controller for any personal data collected from your event guests through the Service
We act as the data processor, processing personal data on your behalf and in accordance with your instructions
You are responsible for ensuring compliance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018
You must provide appropriate privacy notices to your event guests informing them about data collection and processing
You must obtain any necessary consents from event guests before collecting their photos and personal data

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, system upgrades, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance that may affect Service availability.

We are not liable for any loss or damage resulting from Service interruptions, including but not limited to data loss, missed event coverage, or business disruption.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Event Selfie Studio and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Event Selfie Studio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property or privacy rights
User Content uploaded by you or your event guests
Your failure to comply with applicable data protection legislation

12. Termination

You may terminate your account at any time by contacting our support team or using the account deletion feature in the Service. Upon termination:

Your access to the Service will be revoked immediately
Any remaining subscription period will not be refunded unless required by applicable law
Your data, including uploaded content, will be permanently deleted within 30 days of termination
Provisions of these Terms that by their nature should survive termination shall remain in effect

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service interface or via email to your registered address. Changes take effect 30 days after posting unless a longer notice period is required by law.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
